Decision on Spirit Mountain Lawsuit a Puzzler
Judge Heather Sweetland recently ruled against the conservation groups and
individuals who sued to block the Spirit Mountain golf course project until
a meaningful environmental study could be done. In her judgment, Sweetland
wrote, "The party best suited to prepare an EAW or EIS in this case is the
Planning Commission because of its greater expertise in analyzing
environmental impact... This is evidenced by the fact that the Planning
Commission has acted in this capacity for approximately the last fifteen
years and is considered the subject expert on development and environmental
issues." Since the bulk of the mayor-appointed Planning Commission members
have business and development backgrounds, and none have substantive
environmental or scientific backgrounds, some might find this viewpoint
puzzling...
